Redaction

Some reports have had victims names redacted and some assault details redacted.

This is a difficult balance-  normally I would think that  I should not “censor” details but on consultation with various people I have taken the decision to redact. This is mainly to protect victims, their friends and relatives from unnecessary detail and to stop the gratification of those who seek salacious details.

In addition to the obvious “victims redaction” I have thus “assault redacted” across most of the spectrum of abuse. This may obscure sometimes the legal reason for the appeal, but should make no large difference to the vital information for researchers that these documents contain. That information is mainly names of the perpetrators, past addresses, the actual charges the perpetrators faced – on which newspapers are pathetically inaccurate and this information enables the links between people and places and abuse at various times to be ascertained.

JUDGMENT

(As approved by the Court)

1. LORD JUSTICE PILL : Mr Wigglesworth, as the Court indicated when Mr
Hopkins for good reason had a short absence, the members of the Court have
considered your submissions and the appeal against conviction is dismissed
for reasons which we will give in writing. We now proceed to hear his
appeal against sentence.

(Submissions made in relation to an appeal against sentence)

2. LORD JUSTICE PILL : Thank you. We propose to accede to that submission,
subject to this. Would you accept this, that we don’t want to take time now
by setting out all the facts, that would partly defeat the object of giving
reasons in writing because we would set them out twice, but we would
reserve our position of how the figure of ten years is to be made up. So we
are not indicating now, unless you want to make any further submissions on
the point, whether we make other sentences consecutive to rape, or whether
we simply reduce the rape from 12 to ten. Do you have any submission as
between the two? We indicate that we accede to your submission that the
overall sentence should be ten years.

3. MR WIGGLESWORTH: I will explain the position to the appellant.

4. LORD JUSTICE PILL : So formally we quash the overall sentence of 12
years’ imprisonment and we substitute for it a sentence of ten years’
imprisonment. To that extent the appeal against sentence is allowed.

5. MR WIGGLESWORTH: I have no further submissions.

6. LORD JUSTICE PILL : Thank you very much.
