Redaction

Some reports have had victims names redacted and some assault details redacted.

This is a difficult balance-  normally I would think that  I should not “censor” details but on consultation with various people I have taken the decision to redact. This is mainly to protect victims, their friends and relatives from unnecessary detail and to stop the gratification of those who seek salacious details.

In addition to the obvious “victims redaction” I have thus “assault redacted” across most of the spectrum of abuse. This may obscure sometimes the legal reason for the appeal, but should make no large difference to the vital information for researchers that these documents contain. That information is mainly names of the perpetrators, past addresses, the actual charges the perpetrators faced – on which newspapers are pathetically inaccurate and this information enables the links between people and places and abuse at various times to be ascertained.

JUDGMENT

1. LORD JUSTICE RIX : On 30th July 2003 in the Crown Court at
Stoke-on-Trent, the applicant, Callum Thomas Craig, pleaded guilty to 15
counts of indecent assault on a male and two counts of indecency with a
child, those latter two counts being counts 6 and 8. On 29th September 2003
he was sentenced by His Honour Judge Orrell as follows: on each of the 15
counts of indecent assault on a male, 6 years’ imprisonment on each
concurrent and on counts 6 and 8, indecency with a child, 6 years’
imprisonment concurrent and concurrent with the other 15 counts. He also
gave an extended sentence, extending the licence period for 4 further
years. The Registrar has now referred his application for an extension of
time, for which over 2 years and 10 months is needed, and for leave to
appeal against sentence directly to this Court because of apparently
unlawful aspects of that sentence.

2. All of the offences took place before 11th October 1990, count 16, one
of the counts of indecent assault on a male, being the latest of all the
counts charged, as taking place by 11th October 1990. That was before the
effective date of the provisions of section 85 of the Powers of Criminal
Courts (Sentencing) Act 2000, under which the judge had purported to extend
the licence period, and indeed even before that of the predecessor
provisions contained in section 44 of the Criminal Justice Act 1991.
Therefore, the extension of the licence period was unlawful. Moreover, the
offences under counts 6 and 8 were committed prior to 1st October 1997, at
a time when the maximum sentence available for those two offences was only
2 years.

3. In these circumstances, it is necessary to give only the barest outline
of the facts of this case. Over a period of between May 1973 and October
1990 the appellant, as we shall call him, because it is necessary to extend
his time for leave to appeal and grant him leave to appeal against these
admittedly unlawful sentences, sexually abused a total of nine boys, with
whom he came into contact as a result of his association in the sea scouts
and amateur dramatics. He used these activities in connection with young
people in order to gain relationships with youths of between the ages of
about 10 and 15 and he abused children who were in his care as a result. He
regularly visited a number of their families. Some of his victims were
vulnerable children in care.

4. The abuse consisted in  [assault redacted].

5. He was a man of previous good character. In a pre-sentence report the
inevitability of a custodial sentence was recognised.

6. In sentencing, the judge referred to the length of the period of time
and the number of boys involved; that they were vulnerable and that there
was a grave breach of trust; but that it was to the appellant’s credit that
he had pleaded guilty. In sum, part of these sentences were unlawful in the
manner in which we have described in opening this judgment. Mr Harrington,
who appeared on trial and does so again this morning on behalf of the
Crown, tenders his apologies to the Court for failing to bring these
matters to the attention of the judge until albeit late in the day and too
late for any amendment under the slip rule, these matters were bought to the judge’s attention, and he recognised his error but could not correct it.

7. In sum it is necessary to quash the sentences on counts 6 and 8 and
substitute, for the 6 year sentences on them, sentences of 1 year and 9
months to reflect statutory maximum of 2 years and the pleas of guilty, and
otherwise to quash the licence extension of 4 years. In all other respects
the sentences of 6 years on each of the 15 counts of indecent assault on a
male are left undisturbed. To that extent this appeal is allowed.
