Paedophilia around Piccadilly Part 4 Playland Trial and Cover up

Piccadilly 1975

1975 was packed with Piccadilly paedophilia related news and trials. The Billy Two Tone murder trial started on April 9 1975 [1 p172]. It was short but immediately after their sentencing, it was followed by the trial of Roger Gleaves aka “Bishop of Medway on child sexual abuse charges”. When this went against the slippery Gleaves and he was jailed on May 2 by the narrowest of margins, lawyers on both sides concocted a deal on grievous bodily harm charges on Billy Two Tone and others whereby he admitted the charges on the others but admitted nothing about Billy and thus avoided a trial [1 p176].

The Johnny Go Home Documentary was broadcast on 22 July 1975, which the Jury of the “Second Playland Trial” were banned from watching. That nine week trial had just begun, ending in sentencing on September 22 1975. Playland was an amusement arcade in Coventry Street, at the side of Piccadilly, London. Police said they had smashed the biggest ever boys vice ring [87].

The trial then led to a debate as whether the arcades should be allowed to be relicenced or shut down, in particular Playland and 6 other arcades all licensed by Westminster City Council whose licence was due up for renewal the following week [87]. There were also press reports about more prominent and powerful people to be brought to justice [133].

However the events of, and surrounding Playland 2,  show that the rich, powerful, well connected and corrupt manage to evade proper justice. The establishment minimise and shut down investigations to hide the crimes of the powerful, extending even to the sexual abuse of children.

The First Playland Trial or Playland 1 had taken place in 1972. The Judge was Sir Cyril Aarvold, and Det Sergeant Michael Kennan [50] was Police investigator. Five men admitted various sexual offences against 9 boys of ages 13-15 and received sentences of between 1 and 6  years. Those on trial included David Ernest Archer, 23 and Basil John Andrew Cohen aged 24 who lived together at Hartham Road, Holloway, Ian Henry Ashby of Denzil Road, Brent, Geoffrey Storey, Cavell Street, Stepney  and Leroy Peter Jones, an American living at a St John’s Wood address, Aberdeen Place. For the Playland 2 Trial in 1975, there had been a police investigation by a team of seven specially selected vice club officers. The Police investigation was led by Chief Superintendent Malcolm Ferguson, from West End Central Police Station [87]. Inspector Dick also was working on the case [142].

The charges varied in the various papers against each individual but two were accused of living off immoral earnings. It was described as the biggest vice ring busted yet [87], but with at least 2 pimps and “30 rent boys” witnesses, among 70 witnesses, there could have been many hundreds of individuals “users” charged.  Apart from the men charged as pimps, only 3 men were charged.

The Judge at the 9 week trial was Judge King Hamilton, the prosecuting counsel Michael Corkery [90]. John Alliot QC was one of the defence counsels [89] and Hornbys counsel was Mr Robin Simpson [89].

Some of this information gleaned from differing inaccurate newspaper articles is now superceded by the Court Appeals that I have now posted which contain accurate information as to charges [170]

Two of the men featured in both trials- David Archer and Basil Andrew-Cohen. The men charged in Playland 2 were:

David Archer Aged 46 [86] 47 [87] 28! [90] Security guard [89] of Odessa Rd East London. Charges 5 charges buggery [86], 2 gross indecency charges [86], and living on earnings of prostitution [90]. Charles Hornby, Aged 35 [87] 36  [90] Charges He had previously pleaded guilty to conspiracy to procure acts of gross indecency by males under 21 [86], committing acts of gross indecency [86] and attempting to pervert justice [86] [90]. He was not therefore tried with the others but was sentenced with them. Sentence Fined £1000 and jailed for 2 and half years

Andrew Novac Aged 28 [86], 29 [90] Telephonist [89] of Elm Court, Harrowby St, West London, Charges  Plotting to procure acts of gross indecency. 3 counts of Indecent assault [86]. Persistently importuning for immoral purposes [86] Conspiracy to procure acts of gross indecency [86] Sentence 6 and half years

Malcolm Raywood Aged 43. Unemployed [89] Garratt Lane Wandsworth, Charges   Plotting to procure acts of gross indecency. Buggery. Persistently importuning for immoral purposes [86]. Conspiracy to procure acts of gross indecency [86] Living on earnings of male prostitution [86] Sentence 6 years

6th Man  Possibility of a sixth man who pleaded guilty in Jun/Jul but had a separate trial []

The judge summed up for 5 days to the all male jury [87]  The boys were called “rent boys”  because they are mostly penniless runaways who sell their bodies to pay their rent [90] . He also said that what was sickening, was the way the men had tried to suggest they had helped the young boys. “But these boys soon be came young prostitutes selling the only thing they had for sale – their young bodies”, the judge said [101]. Yet oddly the judge said that there was no evidence that the four men had corrupted the boys. At end of trial jury were allowed to watch Johnny go home [87]

One of the guilty men stood out as different from the rest – Charles Hornby.

Charles Hornby received the vast majority of the publicity, partly because he was the only one of the five who made an guilty plea, on Jun 19.The press must have been salivating over exposing him with 3 months to do research. His sentencing was postponed until after the 9 week trial of the others, ending in September. A wealthy socialite, a pillar of society in contrast to the “dirty raincoat brigade” in the newspaper parlance of the day [87]. He had a “beautiful wife”, former debutante Amanda Fitzwilliam Hyde [87] [90], and 3 children.

Hornby was an Old Etonian, he had been an amateur 6 foot 4 inch steeplechase  “gentleman jockey” [87] [89] and had spent five years as an assistant trainer. He left Fred Rimells employ, who has stables in Worcester, to get married [87]. Fred described him as “an extremely nice fellow, we always got on well”[87] . He rode his own horse and  “Gipsy Boy ” owned by his mother and as a jockey had 2 winners at Plumpton in one year [87]. Hornby had also been an officer in the 9th Lancers. He was a Lloyds underwriter, and occasionally apparently had Prince Charles among his guests at his inherited country estate at Shipton Moyne, Tetbury in the Gloucestershire Cotswolds [87] [89]. He was also the brother in law of the managing director of WH Smiths [86], his sister was once married to Marquis of Blandford later the 11th Duke of Marlborough [86] [101] [89]. Hornby also had a town house in Montague Square, Marylebone and “vice” flats at Shortlands in Wembley and at Chepstow Villas, Notting Hill [87].

His brother Simon Hornby married Sharon Sharon Cazalet, daughter of Queen Mother’s racehorse trainer, Captain Peter Cazalet – a wedding attended by the Queen mother, Princess Margaret, Noel Coward, Liz Taylor and Richard Burton and the Archdeacon of Tunbridge.

Andrew Parker Bowles (ex husband of Camilla now married with some title or other to Prince Charles) was, and probably still is godfather to Charles Hornby’s son [131].

Anyhow I am sure that all the foregoing is more than enough to convince you that Charles Hornby was a veritable pillock of society, in addition to being a child abuser.

When interviewed by police, Hornby said “No one is perfect. We are all evil. Fortunately or unfortunately, I have done things that are evil.”[90].

Counsel spoke of “horrid photographs” taken by Hornby showing boys in a bath and committing acts of gross indecency [90].

Hornby is referred to as a Davids rapist who also blackmailed him with photographs that Hornby had taken of him in Davids Story 1 [143]. Audio of all 3 episodes 2015 May 4-6 World at One Davids Story here [144]

Sentencing

Hornby was fined £1000, and sentenced to only 2 and a half years, almost half what the others were sentenced to. Having said this the exact charges are not known, some of his charges were different and Hornby was the only one to plead guilty, and I do not know sentencing guidelines at the time.

Against this he had tried to bribe the boy witnesses to water down their evidence [90] and he was the only one to be charged with perverting the course of justice. He had also took pictures of the boys in acts of indecency [90], though I do not know if this was an offence at the time or what sentence it carried.

The judge said remarkably that the sentences were intended to be an example in deterring others [90].

Vice Ring Cover Up

A day before the sentencing Peter Earle wrote in the News of the World that “Dozens of arrests are expected after the Director of Public Prosecutions [Sir Norman Skelhorn] has acted on a detailed dossier on illegal homosexual activities. Some of the men involved are celebrated in show business, others are top names in the financial world. The arrests will come in the wake of a vice trial at the Old Bailey”

One of the men involved told Peter Earle that he wanted to co-operate with the police because he resented the way “some very big names” were taking advantage of young boys. Peter Earle himself went with the informant to Commander David Helm, head of the West End Central police force. Watch was kept on Playland. And a network of vice was uncovered over a vast investigation over 18 months ago.

It is not clear whether this was the same investigation that led to the Playland 2 trial or a separate one. Peter describes an 18 month investigation, whereas I thought the Playland investigation was 30 months,but admittedly cannot find that source, so I could be mistaken.

However these big name arrests do not seem to have materialised.  In fact the reverse, as the men on trial had their sentences reduced and were released from jail.

Why did the arrests and prosecution not happen? What do Peter Earle and David Helm remember of these events? Who stopped the investigation? Was it Commander Helm or was it higher up in the police? Did Robert Marks hear of this case? Did it reach DPP? Was the Attorney General asked for advice? Was it due to political or other influence? Some answers are likely to be found in the files kept secret from the public for 88 years until 2065. [See below] Who classifies them? Can this be changed?

The Appeal

There was an appeal, which was heard just over a year later, about the number of charges the men faced, originally 38 cut to 19, the length of the trial, the length that the judge had to sum up and the ability of the jury to take in all the 5 days of a summing up. This led in the end to the quashing by the judge of all convictions except on conspiracy and related counts, and  arose directly out of the overloading of the indictment he said.

Even if this was a correct decision in law, who made the original decision to overload the indictments and was it deliberate so that an appeal would reduce the sentences, so that the men in power did not get fingered?

Hornby was already out of jail, after having been kept in jail on remand due to the perverting the course for justice and did not seem to take part in the appeal. Andrew Novac and Andrew-Cohen still had to serve sentences for conspiracy related counts. Raywood and Archer appear to have been released immediately [92]  [93] [93a] and Archer said he would present police with a dossier naming “millionaires and titled and influential people involved in Playland affair. I believe there was a tremendous cover up to protect these people.[93] [93a]

There was even a question by Arthur Lewis MP recorded in Hansard [102] as to whether there would be an independent investigation. Merlyn Rees replied ” No, but I understand from the Commissioner of Police of the Metropolis that he is arranging for the investigation of complaints against the police made by Mr. Archer while in custody. In addition, now thatthe case is no longer sub judice, I will write as soon as possible to my hon. Friend about the outstanding matters raised in the correspondence he has sent me.”

Did he do so ? Are any copies available?

Hornby’s Gun Licence

Hornby got the gun licence he applied for, on 3 April 1977. Normally people were banned from one for 5 years after release but only 9 months after release Hornby got one, and it appears he was still under parole. Given the fact he was on remand from May 1975 his two and half year sentence would have been a minimum of Oct 1977 [95]

His counsel Graham Jones applied to Gloucester Crown Court for ban to be lifted and Police did not object. Hornby aged 37, wanted to kill vermin on the families estate. He said there was no suggestion of violence in the offences.  Recorder Mr John Drinkwater QC offered to withdraw from the case as he had already met Hornby at a party several years ago, but there were no objections. [95] What type of party is not made clear as there are suggestions that Hornby committed some of his offences at parties.[]

Indecent assault not a crime of violence?

Arcades

What happened to Playland and other arcades? Were they closed down?

Wing commander Bill Kearney Chairman of General Purpose Committee of Westminster City Council wanted to shut down arcades as they were vice dens. He said they were “centres of vice where vultures prey” John Alliot QC told the Judge that such places should “cease to exist” but another QC and Chris Tugendhat MP for Westminster South said it would just move it elsewhere. The gaming licences of 7 centres were due for renewal by Westminster Council at the end of the same week in which the sentences were given. [89]

Mr William Molloy, Labour MP for Ealing North, said: “The Old Bailey trial points to the need for immediate co-operation between local authorities, the police and the managements of these arcades.” If this was not given, the arcades must be closed, he said. [133]

Not sure of the result of this without further research or a FOI to Westminster City Council but I think they were shut down but reopened a few years later

Corruption and Cover up

So it appears that from beginning to end the vast majority of the powerful were able to avoid justice, with Hornby as the sacrificial fop, perhaps because he had photographs.

However I think that is misleading. I see justice as what is meted out by the justice system often in statute based courts. Justice is what you get where the Judge and the Prosecution both work for the Crown, and the defendants and the prosecutions legal representative are both in the same Association and maybe the same Inn, and all its other faults.

What we all crave is justness, which will never be achieved from a justice system run by the Crown for the elite. To get justness, then we need to set up common law courts.

So Hornby received justice but probably not justness, whereas his privileged colleagues received neither justice nor justness.

The establishment covers up in a multitude of ways that are hidden from the public, and across not only

1. The separation of powers designed to achieve checks and balances in Britain [132]

  • Parliament – legislature,
  • Prime Minister, Cabinet, Government Departments & Civil Service  executive,
  • Courts – judiciary

but also across

2. Organisations that all are meant to ensure fairness and justice in some way – Police, Judges, Barristers, Solicitors, Attorney General, national and local Crown Prosecution Service, Director of Public Prosecutions,  Home Office and officials, Home Secretary, MI5 and MI6.  I have listed in Appendix 1 some of the main individuals.

The who, what, where, when, why and how of the corruption we are gradually beginning to work out for historic cases of child sexual abuse. However we need to work more of the paedophiles and enablers and more quickly then the task will be easier for the current child abuse.

Please if you can, choose a child abuser, an establishment or an area and try and research some of what has happened, through internet, court records, searches on the internet, personal experience. All information is important no matter how small, to help defeat this curse of child abuse perpetrated often by the people in power.

1973 Jun Hornby “began” picking up rent boys in Playland. Police saw him 4 times and he drove off in red mini. He took boys home and took pictures of them in indecent acts [90].

At their homosexual orgies young boys were paraded as slaves. The boys were attracted to the home of photographer Ronald Fortune because it had a shooting gallery. Many of the boys were indecently assaulted at Fortune’s home in Darrick Wood Road, Orpington.Fortune, 54, was jailed for five years. Judge ordered the jurythey must not see the ITV documentary ” Johnny Go Home” which investigated such a vice trade. Hornby—the brother of the managing director of, W. H. Smiths and himself a Lloyd’s underwriter — pleaded guilty at the outset to conspiracy to procure– the commission of acts of gross’ indecency with persons under the age of 21, committing acts of gross indecency, and attempting to pervert justice. He was remanded in custody throughout the trial. Judge Alan King-Hamilton said he would pleas sentence on all five men on Monday.

Dozens of arrests are expected after the Director of Public Prosecutions has acted on a detailed dossier on illegal homosexual activities. Some of the men involved are celebrated in show business, others are top names in the financial world. The arrests will come in the wake of a vice trial at the Old Bailey. Five men guilty of indecency offences involving boys will be sentenced tomorrow. At the core of the case is an amusement arcade called Playland, near Piccadilly Circus in London. Police have interviewed 152 boys, many of them “Johnny Go Home” runaways, whose search for the bright lights ended in enticement and male depravity. The vast investigation began 18 months ago. It was then that one of the men involved told me he wanted to co-operate with the police because he resented the way “some very big names” were taking advantage of young boys. The informant and I went to Commander David Helm, head of the West End Central police force. Watch was kept on Playland. And a network of vice was uncovered. Pressure was building up yesterday for the closure of Playland and any other arcades where perverts might prowl. Mr William Molloy, Labour MP for Ealing North, said: “The Old Bailey trial points to the need for immediate co-operation between local authorities, the police and the managements of these arcades.” If this was not given, the arcades must be closed, he said. The licences of Playland and six other arcades are to be reviewed by Westminster City Council’s licensing sub-committee on Friday.

LONDON – Last week one of the five men involved in a London vice case asked to be chemically castrated. David Archer, convicted of several homosexual charges, asked the Old Bailey judge if he could be sentenced after he had female hormones implanted in his body, an operation designed to reduce the male sex drive. The judge refused and sentenced him to 5½ years jail. Unlike Mr. Archer, three middle-aged American men in San Diego have had their requests for castration granted. But to escape 20-year jail sentences for child molesting and rape, all three sex offenders will have to submit to an operation which removes their testicles.The practice of allowing men “to barter their testicles for freedom” has just been condemned by the World Health Organization. Its report on the treatment of prisoners and detainees strongly opposes both physical castration and what it calls “hormonal emasculation.”The report points out that in California there was at least one recorded case of a rapist who, after castration, turned from rape to child molestation and morder. Neither is there any proven correlation between the strength of sexual desire and the liability to commit rape.“In fact,” adds the report, “sexually motivated murders by the impotent or near-impotent are not unknown.” (Castration, in fact, does not necessarily lead to impotence. Some castraticans can and do have sexual intercourse.) There is a demand for castration, not only from prisoners, but also from men who have their freedom. In Denmark, 900 men were castrated between 1929 and 1959. Of these, 300 were non-institutionalized men who had requested the operation. A further 300 were prisoners or detainees and the rest mental patients. Of the prisoners, 20 got into trouble with the law after castration.In San Diego, wherein the last 20 years there have been 397 castrations of men who take this course rather than serve a long jail sentence, the operation seems to have kept all the men out of further crime.In Britain, chemical treatments to reduce sex offenders’ libidos have been available for some time. They consist either of tranquilizing drugs or hormone-type compounds and it is the latter which might be described as “emasculation.”Meanwhile, a further problem confronts the three San Diego offenders – the problem of finding a willing and able surgeon to do the operation. The American Civil Liberties Union opposed the penal use of castration and the insurance companies, who insure against medical malpractice, fear that the individual could later sue the doctor on the grounds of state coersion. In these circumstances, San Diego doctors are reluctant to wield the knife.

In R v Andrew Novac & Others CAR Vol 65 1977 page 109 at page 118 Bridge LJ said:

“We cannot conclude this judgment without pointing out that, in our opinion, most of the difficulties which have bedevilled this trial, and which have led in the end to the quashing of all convictions except on conspiracy and related counts, arose directly out of the overloading of the indictment. How much worse the difficulties would have been if the case had proceeded to trial on the original indictment containing 38 counts does not bear contemplation. But even in its reduced form the indictment of 19 counts against four defendants resulted in a trial of quite unnecessary length and complexity. … Quite apart from the question of whether the prosecution could find legal justification for joining all these counts in one indictment and resisting severance, the wider and more important question has to be asked whether in such a case the interests of justice were likely to be better served by one very long trial or by one moderately long or four short separate trials. We answer unhesitatingly that whatever advantages were expected to accrue from one long trial, … they were heavily outweighed by the disadvantages. A trial of such dimensions puts an immense burden on both judge and jury. In the course of a four or five day summing up the most careful and conscientious judge may so easily overlook some essential matter. Even if the summing up is faultless, it is by no means cynical to doubt whether the average juror can be expected to take it all in and apply all the directions given. Some criminal prosecutions involve consideration of matters so plainly inextricable and indivisible that a long and complex trial is an ineluctable necessity. But we are convinced that nothing short of a criterion of absolute necessity can justify the imposition of the burdens of a very long trial on the court.” [troyhand]

[102] Question from Mr. Arthur Lewis asked the Secretary of State for the Home Department Merlyn Rees if he would arrange for an independent investigation into the complaints made by Mr. David Archer, arising out of the Piccadilly Playland call-boy case. He replied no, but the Met Commissioner is  investigating complaints against the police, and he would write to Arthur Lewis about the rest.

Given the fact he was on remand from May 1975 his two and half year sentence would have been til minumum Oct 1977.!! His counsel Graham Jones applied to Gloucester Crown Court for ban to be lifted and that Police did not object. Hornby 37 ? wanted to kill vermin on estate at Shipton Moyne, near Tetbury, Gloucs  on the families estate. He said there was no suggestion of violence in the offences. So rape is non violent offence? Recorder Mr John Drinkwater QC offered to withdraw from the case as he had met Hornby at a party several years ago, but there were no objections!!

Two men from whom ‘no teenage boy was sexually safe’ were jailed at the Central Criminal Court yesterday. Malcolm Raywood, aged 53, was sentenced to three years and Andrew Prichodsky, aged 39, to three-and-a-half years. Raywood, an antiques dealer, of Chelsea Gardens, Chelsea, west London, and Prichodsky, mini-cab controller, of Ash Court, Paddington, West London, pleaded guilty to conspiring to procure youths to commit acts of gross indecency between January and November last year. The court was told that the two man went to Piccadilly Circus and other stations nightly hoping to lure homeless teenagers. The police had launched ‘Operation Circus’ to crack down on such activities.

Kenneth Martin aged 65 had offences dating back 47 years. He pleaded guilty to 4 offences and was found guilty of 11 more, including buggery, aiding and abetting buggery, and indecent assault. Judge Henry Pownall said he was a menace and jailed him for 13 years.  Martin’s first conviction for a sex offence against a boy was for buggery of a 12-year-old in 1942. Since then he has received a string of prison sentences, including a term in Dartmoor, for offences against boys. Charles Wellings, 54, of Hugh Gaitskell House, Stamford Hill, London, was given a total of nine years after being convicted of five offences including buggery, aiding and abetting buggery, and indecent assault. Brian Howard-Edmonds, 60, of Fortunegate, Harlesden, north London, who pleaded guilty at the start of the six-week trial to six offences including buggery, attempted buggery and indecent assault, was given a total of seven years. A police surveillance operation, code-named Operation Hedgerow and launched with the co-operation of Brent social services, led to the current trial and also the unearthing by police of what was described as Britain’s biggest boy-for-sex ring. In February, at the end of a separate trial, four men, one of them a barrister, were jailed for a total of 34 years for involvement in that ring. The jury in the current trial heard that Operation Hedgerow began with a complaint from a 10-year-old boy.

Their prison terms ranged from two and a half to six and a half years. Prosecutor Michael Corkery said the touts worked the Playland Arcade to trap runaway — homeless, friendless and penniless on the streets of London — with promises of money, meals and shelter and then lured them into homosexual prostitution. It is unfortunate however, that for ages it is only women who have been branded and isolated as prostitutes…

In his lifetime he led scores of teenage boys into the world of sordid sex. Now police suspect a terrible vengeance has been exacted on Malcolm Raywood – the man whose exploits inspired the TV documentary Johnny Go Home. Raywood’s savagely slashed body was found a week after he was murdered on New Year’s Eve in a half-way house for ex-offenders in Islington. Police have appealed to London’s homosexual community for help in catching the killer of the 58-year-old man, whom neighbours claim ‘had a string of young male visitors’. With few clues to go on, Det Supt Terry Mansbridge said: ‘There’s nothing really, except for the degree of violence used. But homosexual murders are often very violent. We could well be looking for a rent boy here.’ Raywood had a series of convictions for sordid acts against teenagers and was a prime target for a revenge attack. When jailed for three years at the Old Bailey in 1986, the judge remarked that ‘no teenage boy was sexually safe’ from him.

A man was jailed for life at the Old Bailey yesterday for the murder of a homosexual who tried to pick him up for sex. Edward Hillhouse smashed his victim’s skull with a hammer and stabbed him 12 times. The decomposed body of Malcolm Raywood, 59, who had just been released from prison for sexually assaulting young boys, was found a week later in a King’s Cross, London, hostel.

    A newspaper photographer, a child welfare officer and an American scientist were members of a vice ring, an Old Bailey judge heard yesterday. At their homosexual orgies young boys were paraded as slaves. The boys were attracted to the home of photographer Ronald Fortune because it had a shooting gallery. Many of the boys were indecently assaulted at Fortune’s home in Darrick Wood Road, Orpington.Fortune, 54, was jailed for five years. Child-care officer Brian Johnson, 44, of Gladstone Road, Colchester, was jailed for six years. Scientist George Jacobs, 43, of Elm Park Gardens, West Kensington, was given a two-year sentence.”

      After being immersed in the detail, I need to step back and look at the bigger picture of this story, and link to the rest of what was happening. The quality of the detail on the court cases is also far better than the newspapers and I need to look at including those now. There is also some other avenues to look at like the one you mention. Yes bring any others up.

    So 1 of M finds tell us there was an appeal by 3 of those convicted in Playland Trial No 1 (March 1982) in November of same year. Can’t tell whether ultimately successful but leave to appeal was granted to 3 and legal aid granted.

    On Thursday 23 November 1972 LJ Davies in the Court of Appeal gave leave for 3 appeals to be heard together: David Archer, Ian Ashby and Leroy Jones. ([1972] EWCA Crim J1123-3)Archer was represented by Mr J. Connor – Ashby and Jones were unrepresented and not present (being in prison) and the appeals were adjourned for legal aid to be granted.

    So obvious comment to make but there must be another hearing transcript perhaps early/spring 1973 for Archer, Ashby & Jones where…?
